In the following Policies & Procedures and Terms & Conditions, “the photographer” is RSW Creations, LLC and Rakyah Watkins. “The client” is referring to any individual requesting or purchasing services from the photographer. Services may also be referred to as appointments, bookings, packages or sessions. Policies & Procedures and Terms & Conditions cannot be modified by the clients unless agreed to by the photographer in writing.
Policies & Procedures
Regular processing time for all work is approximately 7-14 business days and will change depending on our current workload. "Approximately" means the time to edit is not exact and may be longer than normal during peak seasons (prom, graduation, etc.) and holidays (Christmas, Thanksgiving, etc.). We encourage you to book your session at least two (2) to three (3) weeks before the day you will need them or like to post them on social media. The processing time normally starts the next day after your session. However, if you prolong the process of selecting your photos, it starts the date after you select the photos you request to be edited. In other words, the day you select the photos you would like to be retouched or edited the photo processing time begins the next day.
All payments are non-refundable. When you secure your appointment/session with a deposit or the full payment, you are agreeing to these terms. Therefore, all payments for any services will be forfeited in all circumstances including reschedules and cancellations. Also, we do not carry balances. Therefore, you will not be allowed to come back at a later date with the expectation of using your previous payment, if you missed your appointment. Please note, the photographer does reserve the right to consider refunding the balance of the full payment, after the deduction of the deposit (i.e. in matters of cancellations at the verbally expressed fault of the photographer, inclement weather, natural disasters).
If you need to reschedule your appointment/session, you must notify the photographer in writing at least 24 hours prior to your appointment. If there is no notification prior to the required time, you will be considered a "No-Show." No-Show clients will not be allowed to book any future services with us. Only one (1) rescheduled appointment/session will be permitted. Any rescheduling thereafter, will require a 20% rebooking fee, only after the full payment is made. In addition, the rescheduled date must be within 60-days from the original date the payment was made to secure your original session.
Note: If you cancel your appointment/session at any time prior to the 24 hours of your booked session, you are able to book another session, but your payment will be retained. If you cancel your appointment/session, less than 24 hours prior, you will be labeled as a No-Show, and your payment/deposit will be forfeited.
Your appointment/session will not be considered secured or booked unless a deposit or full payment is made. If a deposit was made, the remaining balance must be paid one (1) day prior to your appointment/session via an online payment unless, otherwise stated within the details of a specific service/package (i.e. wedding services, where the remaining balance is due ( 7 ) days prior to the date of the wedding).
Late fees are applicable to all appointments/sessions. Late fees are applied at the rate of $25 per 15 minutes with no exceptions. Payment of any late fees must be made, or you will not receive your photos, until you have done so. Your session begins at the start of your scheduled appointment/session time , not when you arrive or after you get dressed (unless approval is given by the photographer). When you are late, you limit the amount of time to fulfill requested services. Preparations for your appointment/session (i.e. hair, make-up) is not included within the time of your session, so please keep in mind time spent during the session for preparation is less time spent shooting during the session. You may purchase additional time if the photographer's schedule permits.
Retouched photos will be watermarked with our business logo unless paid for as an additional service. Additional fees apply to remove the watermark.
Terms & Conditions
Posting to Social Media
The services you request might include high quality unedited photos, or you may request to purchase unedited photos, if they are not included. We ask that you do not permanently post any unedited photos anywhere, including social media or any physical publication, without our expressed verbal or written permission. However, we permit clients to post unedited photos to their "stories" on their social media platforms, where the photo will be temporally posted for a 24 hour period, and then automatically deleted. When you make any posts, including the retouched and/or edited photos and the unedited photos, credit our work by tagging us in the post (RSW Creations/Kyah Shenee' on Facebook and @RSWCreationsLLC on Instagram). We work hard to produce quality images that will last a lifetime, and we hope you appreciate our services by crediting us when you post the finished product.
Copyright and License
The copyright to all work remains with the photographer. Unless, you have requested and purchased the copyright to the photos or video and have received a signed contract transferring the copyrights to you, the client. A license may be granted to the client, allowing the client to print or reproduce the photos, if doing so through another printing company.
Disclaimer
While we strive to ensure the information on all tools used by us are consistent throughout, mistakes do happen. Therefore, this disclaimer is to state that the aforementioned Polices & Procedures and Terms & Conditions supersedes any other Polices & Procedures and Terms & Conditions listed on any tools that we use to provide our services. This is a legal notice that will be used against any disputes made against the photographer, and the client agrees to these Policies & Procedures and Terms & Conditions when they make a payment to secure services from the photographer. The photographer accepts no liability for any failure to comply with this agreement when such a failure is due to circumstances beyond the photographer's control.
